Judge Ismael Moreno, instructor of Koldo case at the National Courthas refused to allow Pedro Sánchez to testify as a witness in relation to the investigation of the alleged criminal plot that profited from the sale of masks during the pandemic. Moreno has also refused to allow Nadia Calviño, former vice president of the Government and current president of the European Investment Bank, to testify, as had been requested by the popular accusations of Hazte Oír and Iustitia Europa so that both could clarify the circumstances. of the public rescue of the airline Air Europa in 2020.
In his resolution, Moreno emphasizes that the object of his investigation is the alleged plot linked to the masks, and that “possible irregularities that may have existed in the aid granted by SEPI for the rescue of Air Europa are not investigated.” The instructor also justifies the rejection in that these testimonies “will contribute nothing new to the effects indicated in the Hazte Oír document” and states that, to determine whether there were criminal irregularities in the signing of contracts with the the plot, Company Management and Support Company, for the supply of masks, these will be found “in light of the information that the investigating police unit obtains, as progress is made in the examination of the content of the different documentation and digital evidence obtained.”
The judge also rejects the testimony of Javier Hidalgo, former CEO of the company, that the accusations had requested to know if any of the people investigated in this case were traveling on their airline and they have also not seen the statement of the former director of the Civil Guard Leonardo Marcos as pertinent, understanding that it is of no interest for the purpose of the procedure to determine their relationship with the investigated Koldo García.
The instructor points out that despite rejecting these testimonies at this time, he does so “without prejudice to what could be agreed upon, if applicable, if it were deemed pertinent at a later time, the practice of any of them as a consequence of the progress, development and result of the investigation.”
Moreno has also denied the prosecution’s request that urged him to ask the UDEF, the Economic and Financial Crimes Unit, to certify all present or past actions regarding the businessman Víctor de Aldama y Koldo García, after whom the case is named. and he was an advisor to José Luis Ábalos at the time in which he held the Development portfolio, both accused, and Ábalos himself, indicated by the UCO report and for whom the judge this week requested his indictment.
