With the fire directed at the pathologist, Dr. Dimitra Karagiannis, the representative of the Legal Service, Xenia Xenophontos through her multi-page apocalypse, she suggested to the coroner as the conclusion on the causes of death of Thanasis Nikolasuh, stay open.

Mrs. Xenophontos noted that “due to the inaccuracies and incorrectness of the information given by Dr. Karagiannis, in contrast to the scientific proficiency with which Dr. Dear, we believe that in the absence of histological findings, it is not possible to safely answer the question of whether the 3 mm deficit in the left horn of the hyoid bone is born during life or postmortem or from its construction”.

In addition to the above, Mrs. Xenophontos indicated to the coroner that the position of the Legal Service is to leave the finding open.

He noted that the coroner’s lack of authority to assess the essence of the testimony and register evaluative judgments (see the case of Christos Christou et al. Application 1AAAD1693 dated 10/07/2015), as well as those mentioned in Nikolaou (see dated 31/12/2008 1AAΔ1342) that the conclusion on the circumstances of death must be beyond all reasonable doubt when the conclusion results in an illegal act or suicide and is not proven on the balance of probabilities and the possibility that in the same Nikolaou case (above) the Death Investigator was given to leave the issue open “open verdict”.

Earlier, Ms. Xenophontos launched a harsh accusation at Ms. Karagiannis, stressing that “in her report she invented an argument about time and arbitrarily came to the conclusion of strangulation alive. I am sorry to note that the non-scientific competence of Dr. Karagianni has been highlighted. He is not a medical examiner but a pathologist. These infiltrations that he found in the photos were not done by any medical examiner involved in the case, which is also their specialty, to express an opinion.”

“Nowhere in her report does she claim to have documented strangulation, she does not state clearly that she did or did not find the bleeding. During her testimony, after all, she told us that their presence in the soft tissues is unrelated to the cause of death, and sometimes, both in the examination and in the cross-examination, she showed us ecchymosis with hemorrhagic perfusions, claiming that it was strangulation.”
